Welcome to Luxetah. By accessing our website and purchasing from us, you agree to be legally bound by these Terms of Service (“Terms”). If you do not agree, please do not use this website.

These Terms apply to all users, customers, and visitors of Luxetah.

1. Eligibility

Where stated, certain products are described as waterproof, tarnish-resistant, nickel-free, or hypoallergenic. Individual results may vary depending on exposure to moisture, chemicals, perfumes, and care practices.

Proper care is required to maintain product longevity.

Luxetah does not guarantee lifetime durability.

3. Pricing & Payment

All prices are listed in CAD unless otherwise specified.

We reserve the right to:

  • Change prices at any time without notice
  • Correct pricing errors
  • Cancel orders resulting from system or typographical errors
  • Limit quantities per customer

Full payment must be received before orders are processed.

4. Shipping & International Orders

Shipping timelines are estimates and not guaranteed.

Luxetah is not responsible for delays caused by:

  • Shipping carriers
  • Customs processing
  • Weather conditions
  • Incorrect addresses provided by customers
  • Force majeure events beyond our control

For U.S. and International Orders:

  • Customers are responsible for all customs duties, VAT, import taxes, and brokerage fees.
  • Refused shipments due to unpaid customs charges are non-refundable.
  • Risk of loss transfers to the customer once the package is handed to the carrier.

5. Returns & Exchanges

We accept returns within 14 days of delivery.

To be eligible:

  • Items must be unworn and unused
  • Items must be in original packaging
  • Protective seals and tags must remain intact
  • Items must not show signs of wear, water exposure, perfume, or damage

Customers are responsible for return shipping costs.

Original shipping charges are non-refundable.

We reserve the right to deny returns that do not meet these conditions.

For hygiene reasons, certain items may be final sale.

6. Refunds

Once your return is received and inspected:

  • Approved refunds will be issued to the original payment method.
  • Processing times vary by financial institution (typically 5–10 business days).

We do not refund:

  • Shipping costs
  • Final sale items
  • Gift cards
  • Items damaged due to misuse or improper care

7. Order Cancellation & Fraud Prevention

We reserve the right to:

  • Cancel suspicious or fraudulent orders
  • Refuse high-risk transactions
  • Limit or prohibit bulk purchases

If an order is canceled by us, a full refund will be issued.

8. Chargebacks & Payment Disputes

By placing an order, you agree to contact Luxetah directly to resolve any issues before initiating a chargeback or payment dispute.

Filing a fraudulent chargeback for a legitimately delivered order constitutes a breach of these Terms.

We reserve the right to:

  • Submit evidence to financial institutions and payment processors
  • Recover associated dispute fees
  • Pursue legal remedies for fraudulent claims

9. Intellectual Property

All website content, including logos, designs, product images, graphics, text, and branding, is the exclusive property of Luxetah.

Unauthorized use, reproduction, or distribution is strictly prohibited.

10. Limitation of Liability

To the fullest extent permitted by law, Luxetah shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits or business
  • Allergic reactions or skin sensitivities
  • Damage resulting from improper care or misuse

Use of our products is at your own discretion and risk.

11. Governing Law

These Terms are governed by the laws of Canada and the Province of Manitoba.

For U.S. and International customers, disputes shall be governed by Manitoba law unless mandatory consumer protection laws in your jurisdiction require otherwise.

We reserve the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of any updates.
